1. Who we are
These Terms of Service (“Terms”) govern your use of the game-server hosting services provided by Play Your Way Hosting (“Play Your Way”, “we”, “us”), based in Perth, Western Australia, Australia (ABN: [to be completed]). By creating an account or purchasing a plan you agree to these Terms.
2. Our services
We provide game-server hosting on a subscription basis. Plans differ in resources (memory, CPU, disk and features) and are billed on a recurring cycle you choose at checkout: monthly, quarterly, semi-annual or annual.
3. Pricing, billing and taxes
- All prices are shown in Australian Dollars (AUD) and are inclusive of GST where applicable.
- Subscriptions renew automatically at the end of each billing cycle using your saved payment method, until cancelled.
- By subscribing you authorise us (via our payment processor, Stripe) to charge your payment method for each renewal.
- You are responsible for keeping a valid payment method on file.
4. Cancellation
You may cancel at any time from your dashboard. Cancellation takes effect at the end of your current paid period — your server keeps running until then, and you will not be charged again. See our Refund Policy for refund eligibility.
5. Suspension and non-payment
If a renewal payment fails, your server enters a short grace period during which it stays online. If payment is not resolved, or when a subscription is cancelled, the server is suspended. Suspended servers retain your data so you can restore access by resolving the billing issue or resubscribing.
6. Acceptable use
You agree not to use our services to host or distribute unlawful content, infringe others’ rights, attack or disrupt other systems, or otherwise breach applicable law. We may suspend or terminate services for serious or repeated breaches.
7. Your content and backups
You retain ownership of the data and content you upload. While we take reasonable care of our infrastructure, you are responsible for maintaining your own backups of any data you consider important.
8. Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, upstream provider issues, or factors beyond our reasonable control may affect uptime.
9. Liability and consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our liability for any failure is limited to resupplying the service or the cost of resupply.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued use of the service constitutes acceptance.
